1. Who can use Ellsby
You must be 18 or older and a parent or legal guardian (or someone a parent has invited into their family space) to use Ellsby. Children do not have accounts. By creating an account you confirm you meet these requirements.
2. Your account
- You're responsible for the account you create and for keeping access to your email and phone secure.
- One account represents one parent. Don't share your login or use someone else's.
- An Ellsby family has up to two parents. Inviting your co-parent gives them full, equal access to the family's shared space, as described in the privacy policy.
- Tell us right away at hello@ellsby.com if you think your account has been accessed without your permission.
3. Acceptable use
Ellsby is for coordinating the care of your children with your co-parent. Please don't:
- Use it to harass, threaten, intimidate, or demean anyone, including your co-parent.
- Enter information about people who aren't part of your family's care arrangement, or use Ellsby to conduct a dispute with a third party.
- Enter information you know to be false, or impersonate another person.
- Try to access another family's information, probe or interfere with the service, or circumvent its security or usage limits.
- Use the assistant to generate content unrelated to coordinating your family, or attempt to make it act outside your own account.
- Resell, scrape, or bulk-export the service other than through the features we provide.
If we believe an account is being used to harm someone, we may suspend or close it.
4. Your content
Everything you enter or upload (schedules, events, notes, photos, records, expenses) is yours. You give us a limited license to store, process, display, and transmit it solely to operate and improve the service, including showing it to the other parent in your family and processing it through our service providers as described in the privacy policy. That license ends when the content is deleted, except for copies in routine backups that roll off within about 30 days.
You're responsible for having the right to upload what you upload. You confirm that content you enter about your children is entered in your capacity as their parent or guardian.
Content you add to the shared family space is visible to the other parent and may remain visible to them after you leave. Please read how sharing works before you add something.
5. Not legal advice; records are what parents enter
Ellsby is a coordination tool. It is not a law firm, a mediator, or a court-approved record system, and nothing in the service is legal advice. The calendar, requests, and history reflect what each parent entered and when; Ellsby doesn't verify that information or take a position on it. If you need documentation or advice for a legal matter, consult an attorney.
The assistant reads text and photos and proposes events or dates. It can make mistakes. You're responsible for reviewing what it proposes before you confirm it.
6. Beta status and availability
Ellsby is in private beta. That means:
- Features may change, break, or be removed as we learn. We'll try to tell you about significant changes ahead of time.
- The service may be unavailable at times, and we don't promise a particular level of uptime during the beta.
- We may limit how many families we admit, and we may ask for feedback.
Please keep your own copy of anything you'd be sorry to lose. You can subscribe to your calendar from another app and request an export at any time.
7. Fees
Ellsby is free during the beta. If we introduce paid plans in the future, we'll publish the pricing and tell you in advance. Nothing will be charged to you without your explicit agreement, and you'll be able to export your data before deciding.
8. Ending your use
You can stop using Ellsby at any time and ask us to delete your account by emailing hello@ellsby.com (see retention and deletion for how that works with a shared family).
We may suspend or close an account if these terms are broken, if we're required to by law, or if we discontinue the service. If we discontinue Ellsby, we'll give reasonable notice and a way to export your data.
9. Disclaimers
Ellsby is provided "as is" and "as available." To the extent permitted by law, we make no warranties, express or implied, including about accuracy, reliability, or fitness for a particular purpose. In particular, we don't warrant that the custody calendar, the assistant's proposals, or any notification will be correct, complete, or timely. Always check what matters.
10. Limitation of liability
To the extent permitted by law, Ellsby and the people who build it will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, arising from your use of the service. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim (which, during the beta, is nothing) or US $50.
Some jurisdictions don't allow certain limitations, so some of this section may not apply to you.
11. Governing law
These terms are governed by the laws of [State, United States — to be set before general release], without regard to conflict-of-laws rules. Disputes will be resolved in the courts located there, unless the law where you live requires otherwise.
12. Changes to these terms
We'll update this page when the terms change and update the date at the top. For meaningful changes, we'll notify you in the app or by email before they take effect. Continuing to use Ellsby after that means you accept the updated terms.
